Legal Question in Credit and Debt Law in New York

marrital credit

summer of 2005 my spouse whom ive been seperated from for 4 years took out personal loan in his name to help me put new tires on my car and with some of my other debt we are still seperated he now has a live in girl freind .ive been paying the 100.00 dollar loan even though it is not in my name. Am i or would i in court of law be obligated to that debt if i decided to no longer pay seeing how he has someone else he is living with and im struggeling to make that payment?

if you are not mentioned in his loan agreement you are NOT responsible to pay. If you made an agreement with your husband to pay him back he would have the right to pursue you for payment, but you are NOT responsible to the company who lent him the funds.
