motion to dismiss

I was an authorized user on my son's credit card. I charged 8000. he never used it.He was served for 14,000. It's been one year since our answer and the credit card comp. has not responded.Our lawyer said if we send a motion to dismiss they will probably respond with a written response to resume prosecution. - trial. What are the chances that they will not respond and or what can we expect. Have to make a decision and don't know how to proceed.
