Legal Question in Credit and Debt Law in New York

Sued over credit card debt

Someone came to my home and handed my son court papers. It said I was being sued. I called the number on the paper and they said it was for a visa Citi Bank credit card from 2005? I never had a visa card in 2005. Many years ago I had one from 1994? Not sure.

They want me to pay $300. a month for a $3,000 debt. Im already behind in my rent and can't pay my bills on time at this time. I was told to go to court and make payment arrangments.

I don't know if this is really my debt since it's from 2005. I know I can't pay $300. a month if it's mine. Not sure what to do at this point.

Someone said file bankrupcy. Is that my only option? What do I do?

Re: Sued over credit card debt

You must go to the courthouse and ask the clerk for help in preparing and serving an answer. Make sure to bring with you the summons. The clerk will give you a form to allow you to answer the complaint. Make sure to write on the answer that you never had a Visa Citi Bank credit card from 2005.

Mike.
