Legal Question in Criminal Law in New York

I am 21 year old girl living in New York. I was caught shoplifting for $500 worth of stuff from Kohls. This is my first offense. I was arrested and am given a court date. What will happen at this first court date? Will i go to jail? Should i already have a lawyer or can i ask the court to provide me with one? Should i just plead guilty? What can happen to me?? Please help =(

If you can afford a private attorney, by all means retain one before your court date.If you can't the court will assign one.A private attorney will give your case the attention it deserves. Since it is your first arrest I don't believe a jail term is applicable. The sticky point is whether you have a viable defense or will you need a skillful attorney who can prevent you from receiving a lifelong criminal conviction on your record. The first court date is for arraignment. That is the procedure where the judge will decide whether or not he will set bail on you. This will be determined by factors which inclede your prior record (none) and your ties to the community. There are collateral consequences of a plea and these should be discussed with a lawyer. A misdemeanor conviction can result in a criminal record. It may prevent some companies from hiring you etc... Also, be aware that Kohls will probably send you a letter (civil matter) stating you owe a fine for your alleged conduct. Legal Aid can represent you if you are indigent.
