Legal Question in Criminal Law in New York

aggravated harrassment

If a person files an aggravated harrasment charge against you and that persson resides in another state (3,000) miles away, is this an arrestable offense? Do I get a summons to appear or just get arrested?

Re: aggravated harrassment

It is an arrestable offense. In fact it is a Class A misdemeanor. The police can arrest you and put you through the system, which means spending a night in jail, or the police can give you a Desk Appearance Ticket, which means spending around 4 hours at the precinct before being given a date to appear in court.
