Legal Question in Criminal Law in New York

i got an endangering the welfare of child vioation section 260.10. can they use a statement by my brother towards me, if he did not sign it nor got into any trouble for it? also can they say i willfully and knowingly and lawfully comitted the crime when my statement says that the store says it was legal for the burnable incenses?
