Legal Question in Criminal Law in New York

My husband works for a bread distributor, and one of the accounts was robbed. The police want to question, fingerprint and take dna from him. He did not commit the crime, he can prove his whereabouts at the time they say the place was broken into. He was doing his route and saw multiple other customers at the time. He has never been arrested of even accused or suspected of a crime. What are his rights when it comes to this situation? He would prefer not to have his fingerprints or dna in the system. He has already given a verbal statement to the investigating officer over the phone, stating that the store was not broken into when he was there and he saw noone in the area.

No matter what, your husband should NOT cooperate and NOT give any further statements until he has an attorney representing him. This is his right.

He has the right to not cooperate, make no statements, give no DNA and not give his fingerprints.
