Legal Question in Family Law in New York

Okay this is a child custody question.. I live in NY but my son was born in PA and i falsely put a my boyfriend at the time name on the birth certificate. I have a paternity test court date for the real father. However my ex boyfriend who is on the birth certificate is trying to cause problems and says he can get me for kidnapping because i moved out of state. Is this possible? could i go to jail for a year for this? how can i fix this? the man is unstable. Please help me!!!

No.

New York falsifies birth certificates all the time. If they can do it, I cannot see how you cannot do it. If the man is found not to be the father, he is just removed from the certificate. Moreover, the birth father can always petition the courts to correct the birth certificate.

Is there a visitation order? Has he acknowledged paternity? If not, there really isn't an issue.

Hire a local family law attorney to correct the paternity issue. If there is a visitation order, you will have to comply with it until his rights are stripped.
