How can I get a divorce in nys if my husband got deported 13yrs ago

If you are living in NY for over two years, you would have jurisdiction to obtain a divorce here. You would have to locate your husband - even if he does not live in the United States - and serve him with a copy of the summons and complaint.

The above answer is not complete. You can still get a New York divorce even if you cannot locate your spouse. However, due to the extra filings and procedures involved, there are substantial extra costs, including motion preparation and filing, affidavits by a process server, and court-ordered advertising. It gets expensive. Unfortunately, if you cannot locate your spouse, this is the only way you can get divorced.
