Legal Question in Family Law in New York

Divorce Sealled Reocrds... Definamation of Charater

I am about to go thru Divorce. My wife is having an affair w/ a Married man... he is a millionaire. His wife does NOT know. This has been ongoing for ~ 5 years. I found out about the affair in DEC 08.

I only found out in Feb 09 that the GUY IS STILL MARRIED! I think about calling his wife everyday and telling her the details.

MY court procedure has not yet started. It starts this Tuesday March 17th 09.

I heard that Divorce records are sealed...

but does that mean the parties involved CAN NOT talk about the details with whom ever we want?

When ever they want? After the Divorce?

I want to tip off his wife to something.

At least send her an e-mail.

Or a fed-ex envelope w/ info.

MY Lawyer said DO NOT do it. It will make me look bad and might hurt my custody case. But he did not say I CANT!

Will the judge open MY Divorce with statement about confidentuality? That I will have to adhear to?

Will the Judge say that ALL aspects of this trial are to be sealed and not discussed out side of the court room under legal penalty?

I do not want more trouble. BUT IF I want to contact her, DO I have to DO IT NOW?

Prior to my trial start date?

Matthew

I agree with your lawyer. You gain nothing by tipping off the married man's wife.

If you must contact her (and you shouldn't), I would wait until after the divorce is complete.

Mike.
