Legal Question in Family Law in New York

I gave permission to my wife while legally seperating to come back to Buffalo NY. 6 months ago. I am returning home from the Navy in December and she wants to take the kids back to Virginia to live. Can she do this without my permission?

If the kids have been in NY for 6 months and there are no prior orders of custody, if she leaves with the children to VA you have remedies available to you in court to force her back here with the children.
