Legal Question in Family Law in New York

My husband and I had an argument and he has not returned home for 3 days. Last June he tried to strangle me and I have a 3 year restraining order, although the marriage improved for some time. My husbands daughter from a previous marriage is extremely toxic and I believe (because she has said it) that she is using drugs. Does my husband have the right to bring her on visits with my son. I am uncomfortable with my son around her.

Unless the Court says otherwise, your Husband is not restricted in who he brings to visitation. That being said, if the Court finds that it is not in the child's best interest, it can put restrictions upon who is around your child.
