Legal Question in Family Law in New York

Can I leave my house without abandoning the marriage and losing more then I already have? He is abusive, financially, mentally physically, verbally alcoholic, with other mental illnesses. He's never been faithful, in 6 years? Our house is in foreclosure

Does not sound like you have a lot to lose; an abusive husband is dangerous and you may get hurt. You safety and health should be of main concern.

I would see an attorney immediately. The new divorce law that is due to go into effect next month could give you relief you seek or you can start an action under the current law and get out now. I would get out either way. Remember that abandonment requires a full year outside the home to have any effect under the law.
