Legal Question in Family Law in New York

Is it legal in NY state for lawyers to work on a contingency basis when the case regards an attempt to change an existing alimony agreement in a divorce that was settled 7 years ago?

The lawyer we've spoken to wants $20K retainer up front (and it could go higher, depending on how the case goes), which we simply don't have available in a lump sum.

Also wondering what incentive there is to really put effort into the case if she's getting so much money up front, win or lose.

No. Contingency fees are not permitted in matrimonial matters in New York.
