Legal Question in Family Law in New York

I live in NY state. We have been married for 6 years, have 2 kids and soon we will have the third child. I don't work and for a year my husband is not working (he was a driver) . We live in a house that he had before we got married.

I want to divorce, but I want the kids to live with me.

What should I do to have more chances?

Should I get a job or start some training classes (I have a degree, but I need more classes)?

He may be able to get disability and this will give him more free time.

You are seeking to be the primary residential parent. To strengthen your case you need to be the parent who goes to the children's medical appointments, makes the decisions regarding school, extra curricular and camp. You should also be the parent to make meals, set up play dates, attend parent teacher conferences and read bedtime stories.
