Legal Question in Family Law in New York

Im not married nor have I been, but I have a child support issue. He was ordered to pay 81% of childcare expenses and medical expenses he is in arrears for both and i was told that being that he is in arrears he would have to pay for my lawyer, is this true? Also he claims that cause he worked overnights and I was not working at the time that he does not need to pay for her schooling, is this true?

A. Maybe. Pursuant to Domestic Relations Law section 238, he would be responsible for attorney fees. However, the court would still have to award the fees.

Q. Also he claims that cause he worked overnights and I was not working at the time that he does not need to pay for her schooling, is this true?

A. It would depend on the language in your separation / settlement agreement with your ex.
