Legal Question in Family Law in New York

order of protection

How can I vacate or nullify an order of protection filed against me under false pretenses in the state of New York

Her motive is to force me to separate and remove me from the marital residence where I live with my 4 year old son.

Re: order of protection

Presumably it's a temporary order of protection. If so, there's a hearing date at which you or your attorney will be given an opportunity to present evidence and to cross examine witnesses against you.

If it's a permanent order, that means you've already had or missed that hearing, which makes things more problematic.

Either way it would be prudent to engage an attorney experienced in these matters to represent you.
