Split custody child support
Under the current separation agreement (3 years old drawn up jointly with no lawyers) we both have full custody with no child support due to either mother or father. My sons(ages 21, 22) have lived with solely for the 3 years and my daughter(16)has lived solely with her mom. The mother is now asking for 17% child support for my daughter. I am certain she will use my money to lure my sons away from me with gifts and promises. Do I have any options to fight this? Does the one child rate of 17% apply to one of 3 children when I am supporting the other 2 children(now ineligable)? I offered to put money in a joint account and for only the 3 kids to have access to it and suggested she put her fair share in it too, but that was not acceptable to her.

Unfortunately, if your daughter is in the custody of her mother, you are obligated to pay support in the approximate amount stated. As you recognize, the mother is not chargeable with the support of the older children. Please call me at 212-367-9167 if you wish to discuss your case further. Unfortunately, the two "children" in your custody have become emancipated. You are responsible for the support of the unemancipated child.
