Tempory Order Of Custody

I have a court case on the 27 of jan. cause my X did not comply with the settlement agreement and didn't notify the court b4 the divorce came into efffect she left NY with our 2yr old...What can i do to enssure i get custody of my daughter?? P.S: she also have another child 6mos. now not mine which she knew about before the divorce...
