Legal Question in Family Law in New York
Hello, My wife moved out in April of last year. We have been divorced since October of last year and she has custody of our only eligible child. I have been paying alimony and child support and still do. She recently lost her apartment and her job and I have taken her along with her 20 year old daughter from a previous marriage and my son back into my house. I have a legal two family home. She and her daughter are supposed to be sharing a bedroom in my mothers apartment downstairs but she has been sleeping upstairs on the couch. My Mother is charging her 400 dollars a month to help with all the bills since my Mother pays all the bills and supply's the food. My son lives in the upstairs apartment with me and my brother who moved in to help me pay the mortgage after she moved out. My son has his own room he is 10 years old. I buy all of his food,clothes,school supply's and he is under my medical coverage my ex does not pay for anything of his. I currently pay 600 dollars a month in alimony and 350 a month for child support she is also receiving 1,500 in unemployment and does have a job working for an insurance company but she only works about 5-10 hours per week. I want to find out if I should still be paying the full amount for child support and alimony or should I retain an attorney and take her back to court ? Yes . . . but you may want to consider a negotiated settlement before you go to court. In any event, I seriously doubt that you should be paying any kind of support in this situation.
