If an arbitrator awards a plaintiff more than whats owed what should the defendant do?

Generally, the defendant may commence an Article 75 action in Supreme Court to modify or vacate the arbitration award. To win an Article 75 petition, the movant must demonstrate that the arbitrator's award was arbitrary and capricious.
