Legal Question in Civil Litigation in New York

Civil Lawsuit Against Small Business Owners

A former web site client has filed civil lawsuit against my wife and I in Manhattan, even though the business transaction in dispute occurred in the state of California. We now live in Texas and the business was dissolved years ago. Where should I begin?

Re: Civil Lawsuit Against Small Business Owners

You need to Answer the Complaint within 20 or 30 days (depending on how service was effectuated). Beyond that, any attorney would require much more information the type of business transaction, a copy of the contract involved (if any), the amount owed, the date of the transaction, etc., etc.

If the business is dissolved and there is nothing to collect, a Plaintiff can often be convinced to simply discontinue or settle for a "nuisance value".

Hope this is a helpful start.

That question can't be answered solely on the facts you provided - more detail is needed.

I'd be happy to discuss the issues with you - feel free to get in touch either via e-mail or phone.

(By the way, the previous answer is not precisely correct. Instead of an answer, the appropriate response could be a motion to dismiss - but that depends upon the circumstances.)
