Legal Question in Civil Litigation in New York

''Can husband sue his present wife''

1)I am still married to my husband and he has three cases against me right now. In one case he is suing me for liability damages(deformation of personality). How is it possible and how would the judge determine if I have to pay him and how much if we are not even legally sepaprated? We are married , our property or any other valuable items are not divided. My husband didn't mention that we are still married. Can such case exist at all?

2) If the name of one of the defendants on the case is incorrect (wrong last name) does the whole case would still be considered efficient?

Re: ''Can husband sue his present wife''

This case is nonsense. There is no such thing as a cause of action related to "deformation of personality".

But you must respond. Submit this to the court: The defendant denies each and every allegation fo the complaint". That is a general denial and will prevent a default judgment.
