Legal Question in Civil Litigation in New York

Judgement question

Hi, My father and I have the same name and I have been out of the country for the last 6 years. I was recently told that I was taken to court by an ex girlfriend a few years back and she won a judgement against me because I never even knew about the court date or anything. Well, now she is trying to collect with the added intrest. Can she do that?

Re: Judgement question

Yes, she can do that.

However, what you can do is to make a motion to set aside the judgment. That motion must be made in the court that granted her the judgment, and requires a showing that a) you did not receive notice of the original court case, and b) you have a valid defense to the case she brought against you.
