Legal Question in Civil Litigation in New York

Personal Car Loan

My friend purchased a car for me and I was supposed to pay him back for the car. All papers were in his name until the full payment was given to him but I had custody of the car since the purchase. I made him 5 monthly payments by check until I was unemployeed. I also ivested money into the car. One day he ''stole'' the car from my neighborhood while at an interview. He cut the club I had on the car and changed the locks. I'm taking him to small claims court for the money I invested into the car and the 5 payments I made. He took the car claiming that I missed two months of payments but we spoke everyday and never said anything about me missing payments, in fact he told me that to forget about the payments until I find a job. Would I be able to get my money back since he is using the car now for his own pleasure and he practilcally stole the car from my posession? I have receipts and deposit slips to prove the amount of money invested into the car I though would be mine once I payed him back. Thank you!

He is, in effect, using his own car.
