Legal Question in Immigration Law in New York

Applying for GC

I have been in the U.S since I was 12 yrs. I married a U.S born citizen but have been seperated since 2004 due to an abusive relationship. I don't know where he reside currently. Can I still apply for a green card?

My student visa has been expiered. I have my license, ss and I am working currently but my passport from my country has been expiered.

I don't know anything about my native home and I need to know how I can apply for a GC. Am I eligible and where can I start to get one?

I have not gotten any advise from anyone all these years and I would like to know where to start. Thanks.

Re: Applying for GC

You should definitely speak with an immigration attorney. Depending on your situation and the specifics of the abusive relationship, you may be eligible to self-petition for a green card. This means while normally, you would need a US citizen or a green card family member to petition for you to get a green card, as a "battered spouse" you may be eligible to petition for yourself.
