Legal Question in Immigration Law in New York

I am French, H1B older, planning to start an EB1 application in 1 year. My girlfriend is Chinese on her 5th year of H1B. When should we get married so that she doesn't have to wait for her Green Card in the Chinese line ? Does it matter if she start her Green Card process through her employer before ?

The cross-changeability rule may apply to your girlfriend if you marry her so she will not wait in the Chinese line, which might shorten her green card application process. We suggest you to consult with an immigration attorney to discuss your options.
