Legal Question in Immigration Law in New York

An illegal boy wants to get his novel published.

My nephew,19,entered USA 3 years ago, legally with his family on a bussiness visa.Somehow, they became illegal. They boy has been a very good student at High School with good moral character. But he couldn't go to college because of having no S.S.# and getting no financial aids. He has written a wonderful novel, that his teachers are insisting him to get published. But his family is afraid that this way they might come in sight of INS and get deported. I want to know if this can happen. Will they deport him and his family, if his novel is published here? Is there any chances of his getting legal here if his novel becomes a hit, tops the list of bestsellers . All those people who have read it, say its a wonderful thing and must be published. Are there any chances of getting any benifits for its author if the novel becomes a hit. Is the law about ''doing extraordinay work'' will be of any good for this author?

Thank you....

Your son sounds like an excellent candidate for the 'exceptional talent' qualification for a green card.

Yes,your nephew could be deported. However, if the book turns out to be a great hit he might be able to gain a legal status. There may be a problem becuse he has been in the US for more than a year after his visa expired.More details need to be clarified. Speak to a lawyer
