Legal Question in Immigration Law in New York

immigration status/divorce

Me and my husband have been married since 1998. in 2000 I sposored him for a green card as his wife. He still has not received it -and his case was denied a month ago - there was a problem in filing. Our immigration lawyers says, since it took so long, and since they denied it now he recommends that we start the case from the beginning, because it would take much less time (6-8 months), as oppose to reopening the old case - that may take longer.

Our problem is that we want to get a divorce - lets say we postpone the divorce until he gets his green card, can we get a divorce as soon as he does get it? Thank you
