Legal Question in Immigration Law in New York

Marriage with US citizen

I am H-1B visa holder, will marry to a US citizen at the end of April. Do I need to get work permission, and how long it takes?

Re: Marriage with US citizen

You probably would want to get Employment Authorization Document since, unlike the H-1b status, it allows you to work for any employer anywhere in the U.S. You can apply for EAD at the same time as you apply for adjustment of status. It takes a few months depending on where you are located. You might also want to apply for an advance parole to be able to travel overseas while your adjustment application is pending. Get an immigration attorney to assist you with all of these things -- it takes more than simply filling out government forms to get it done right.

The above reply is in the nature of general information, is not legal advice and should not be relied on as such.
