Legal Question in Immigration Law in New York

For many years I lived in New York, USA but i was undocumented. In 2003 i was wrongly accused by someone I didn't know for using their identity to obtain a US Passport. I was arrested but the grand jury threw out the allegation. I left the states shortly after in 2004. I have lived in Europe legally since. The passport fraud is alledged to have occurred in 1997. I would like to visit my family in the states but I am afraid of being accused again as I don't know if they had thrown out my fingerprints after I wasn't indicted.

Is it safe to return to the US? I ave so much to lose if I end up even being arrested again. Thanks.

From what you say, the charges were dismissed. I would need confirmation. Additionally, I would need to find out if you are inadmissible in any other areas of the law.
