At fault driver denying accident

my daughter was slammed from behind (knocked off her headband), while stopped at a red light, in pouring down rain. he wasn't paying attention.

he gave his name and cell phone number to her and said he'd pay for it.

she's 18 and a first accident, he's 17 and his second. dads car.

no response to calls, insurance says insufficient evidense and he lied about everything.

she described him wearing a certain leather coat, dad says he doesnt own one, but hes still wearing it to school. the football coach ''is real sure'' he was at practice evenntho other players say there was no practice. that's what was told to the insurance company.

our car is totaled, now what?

we can't afford to fix it propery

he told his friends he did it but wont talk about it.

we went to the er, whiplash.

his family is blaming the woman

across the street from them.

daughters phone was dead, so no police were involved, but i did make a citizens report the next day.

i refuse to let them get away with this.

is it within my rights to contact the 17 year old on his cell or should my daughter call him) or should i call the parents? i don't wamt any retaliation, at school, against my daughter.
