Legal Question in Employment Law in New York

Got Fired.

Was wrongly accused of stealing something at work and got fired. Now they noticed it was not me and want me back. After humilliation, is there a case here? It's a well recognized corporation.

Re: Got Fired.

That's a difficult case. NY is an at-will state and firing someone for thinking they're stealing is not unlawful. There's also certain privileges against a defamation claim, so that doesn't bode well either.

Your best bet may be to try to use their wrongful accusation and subsequent apology to increase your pay, title, or benefits. If you need assistance putting together something or want to discuss this further, you may contact my office through SeveranceAttorney.com.

Good luck!
