Legal Question in Employment Law in New York

Hostile work environment -ny

what are the employers obligations to correct a situation that involves two employees, one that has shown physical aggression towards inanimate objects in the presence of other employees as a means of intimidation towards a co-worker. Also, said employee is known to carry a knife in the workplace. she continually tries to provoke the other employee when they are alone. I have gone through all the proper channels with no results except suggesting to ignore and avoid this employee. I was told that I was over reacting and if the situation was upsetting me that I should seek out the EAP and they might help me figure out why I just can't ignore this co-worker and not get upset.

Re: Hostile work environment -ny

This is a tough situation for you. An employer has an obligation to maintain a safe work environment. IF you truly believe this co-worker is a threat, and your boss isn't taking you seriously you should call the police and report the situation. In any event, unless it is regualr work equipment, employees should not be carrying knives around the office.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
