Legal Question in Employment Law in New York

Retirement Benefits

I was a union member for local 174 for 20 years. When i retired at age 62 they gave me 416 dollars a month but yet people that retired after me are starting at 1500 a month. I want to know what I can do in order to receive the same benefits. Did I do something wrong? Please get back to me as soon as you can.

Re: Retirement Benefits

You should talk to your union representative and have him or her explain the pension plan to you. You mention that you retired at age 62. Many plans require a lower monthly benefit if you retire before age 65. In addition, pension payments are often based on your earnings, frequently using the last 3 or 5 year average earnings to compute the benefit amount. Again, your union representative will have the details. If you still have questions after you talk to the representative, you should see an attorney who is experienced in retirement plans, ERISA, and unions. Feel free to call my office for an appointment if you would like to discuss this further.
