Legal Question in Employment Law in New York

workplace harassment

My husband has been getting harassed at work on and off for a couple years. Today, he found that someone had broken the lock on his locker. He owns the lock. The supervisor is going to have the police come and make a report. He wanted to know if there are other avenues he should pursue. he is a municipal worker and belongs to Afsme and CSEA.

Re: workplace harassment

Additional details are required about the harassment directed at your husband and the motives

of the harassers, to adequately answer your question.

Are their any indications that the harassment was motivated and directed against your husband's race or nationality or religion or age group or any disabilities or gender, etc.?

If so, then you may have the basis of an employment discrimination lawsuit.

If not, then depending on the specific type of hrassment involved you may have a baisi for alwsuit for, e.g., defamation or assault or intentional infliction of emotional distress among other possibilities and a lawsuit against your husband's employer for negligent supervision (or negligent retention or negligent hiring) of the employees involved in harassing your husband.
