Legal Question in Employment Law in New York

wrongful discharge from job

My husband was fired from his job as a restaurant manager after a theft occured on the premises. The robbery took place while the establishment was closed. He was only the manager of record the night before. There was never a completed formal investigation prior to his termination, however following that he took a polygraph and passed. In addition they have not paid him for vacation time accrued. I feel that he was wrongfully discharged with no evidence of his participation in this crime and used as a scapegoat. Do we have a potential law suit?

Re: wrongful discharge from job

It depends on many factors but he could. It is a common excuse to fire a manager of a business, not robbery but missing money.

Do you mean investigation into his involvement, or the robbery? If you would like to discuss this, perhaps you would contact my office for an appointment?
