Legal Question in Landlord & Tenant Law in New York

I just asked:

"Posted by: Alexandra O'Brien

We sublet a Columbia University faculty apartment for two years. Prior to that, said apartment was sublet by three law school students. Primary tenant was away in Italy for this five year period.

We moved out of this apartment a month before the end of our lease as a convenience to the primary tenant who wished to move into a new apartment offered to them by the university. We moved out July 2009. We have yet to receive our security deposit. "

I realise we moved out summer of 2010, not 2009, though that's not important at this point.

If the security deposit is under $5,000, you can commence a small claims action against the subleasor for the return of the security deposit.
