Legal Question in Landlord & Tenant Law in New York

Reasonable amount of Time

I was sent a certified letter by my landlord that I needed to make past due rent payment within 5 days of receiving this letter or legal proceedings would begin against me.

QUESTION: Is 5 days legally a reasonable amount of time to do this or was this a non legal arbitrary number of days n

Re: Reasonable amount of Time

I think there is some confusion here on the "5 day notice".

5 days is sufficient notice to sue you for rent only (for a money judgment), but 10 days notice is required for eviction/holdover as a summary judgment and 30 days notice for a regular eviction/holdover.

The notice required is diferent depending on what the landlord is seeking.

You are welcome to a consultation for no fee at my offices at 42 west 44th street, NY,NY. Please call for an appointment first (646) 591-5786.
