Legal Question in Legal Ethics in New York

lawyer problems

can i take a lawyer to sm claims court if it has taken almost 4 years to get papers from the exec of my moms will? the only time i can talk to him is if i make an appt. he tells me hes waiting for the county clerk to return his call, but when i call the courthouse theres no record of him calling. they already sent 2 letters of assignment. i hired him in jan 2005. my mom passed nov 2004. i paid him 1500.00 and he knew thats all i had. he already contracted a med case from me and made 16000.00. my sister cleaned everything out and i let some family members down who were counting on me. i can't give my parents back their dignity either. also the lawyer never asked me for more money. he shouldn't have accepted the case if he didn't want to bother. this is a family. these are real people. and i can't visit my parents at their graves because i failed them most of all. so can i get a refund for services not rendered?

There are arbitration/mediation services available through the local bar association. You can receive the information if you telephone your county's bar association.
