Legal Question in Medical Malpractice in New York

My mother recently passed away after being in the hospital for 2 weeks. She was released after contracting C-Diff 3 days prior to her release. Found out that she was never given any antibiotics before she left for this. Could this be negligence?

Wondering how she could be diagnosed with such a potentially serious infection and not be prescribed antibiotics. Get the entire hospital chart and show it to an attorney. Best, M. E. Zuller
