I don't have enough info to really give you legal advice so I am just letting you know what I do in these cases and you can get an idea of what you might wish to do. It is not easy to upgrade from less than honorable discharge (or worse), and the military generally looks for five+ years of leading a good life-depends on what was on your DD 214 form/what you were discharged for, military needs, the economy, did you have a good reason you have since cleared up, etc. Right now, even though we are still at war, more people are signing up for the military as a viable option for financial (albeit not personal) security. I advise clients to volunteer at a VA hospital AND at an animal shelter training animals for adoption. This way, we can show the clients see the value in training as a matter of life and death-for the client and his/her squad in the military and for the dogs at the shelter (since well-trained dogs get adopted much faster, before the euthanasias are done). And, of course, volunteer work at the VA shows dedication to other military members and their families. Then, we submit the proof, letters from family, me as the attorney, boss, heads of the volunteer group(s), bosses working at the VA and animal shelter, proof the problems that led to she discharge have been addressed, etc. to the local Congressperson (US Congress-House of Reps). Keep in mind it is election season also.
