accident report

Is a supermarket entitled to give a copy of an accident report to the victim of a fall? I was unable to get a copy of the accident report. Why? There are two witnesses and I need the names.

In order to answer your question, additional information is required. For example, what type of accident? Was the accident report generated by the supermarket, their insurer or the police? Have you commenced a lawsuit against the supermarket?

Normally, you can obtain a copy of the police report. However, if the accident report was generated by the supermarket or its insurer, they will resist giving you a copy. If, however, you have started a lawsuit, you can request a copy of the report in discovery and they will have to give it to you.

If you signed the report, go to the manager and ask for a copy of it.

If you did not, write to the store and ask for a copy of it, reminding them in the letter of the date of your fall. Do not say anything else other that you fell, the date, and that an accident report was filled out that you want a copy of.
