Legal Question in Personal Injury in New York

My dog bite outside of establishment con't

Thanks so much guys...However, I was served with a summons in which the plaintiff was trying to take me to court for monies, however, that is all that was done. I''m not sure if it was just that she couldn't afford representation or what but I haven't heard anything about the case from her attorney since 8/24/08 in which i was just given the summons...There was no witness and she doesn't even have my name...She followed me and found out I had a store that's the only reason she knew I had a store.

Contact your insurance company or broker or lawyer TODAY and let them know you received a summons in August. Technically, your time to answer or otherwise react may have passed. This can likely be fixed, but the longer you wait, the harder it becomes. Good luck. Best, MEZ

Re: My dog bite outside of establishment con't

I would implore you: Call and get a free consultation with an attorney. You are making some extremely, extremely risky assumptions. If I have an unusual bump on my arm that stops growing after a while, I don't assume it's a funny-looking wart; I go to the dermatologist immediately.

Don't think that you weren't properly served with a summons. A summons is very easy to serve. You don't have to be grabbed physically by a process server and have it stuffed down the front of your shirt.

Also, only a month has past. If you notify your carrier(s) now, they will be required to protect you if a suit goes "full-swing". Otherwise you will be on your own. I've seen similar cases bring my clients near to bankruptcy.

I truly hope this is helpful.

Marshall
