Legal Question in Personal Injury in New York

I fell on a sidewalk in New York City and broke my foot. I fell after stepping into a "sidewalk pothole". Can I sue the city?

You may have a cause of action for a defective sidewalk against either a private property owner or the City of New York, depending on exactly where the accident occurred. A thorough inspection of the location is necessary. It is also important, though not absolutely necessary, that an accident report was filed (this can also be accomplished if EMS was called to the scene as they would document the date and location of the pickup). The case is likely against the abutting property owner, which is an easier case than against the City. If you do need the City you need to serve a Notice of Claim within 90 days of the accident. Feel free to contact me.
