Legal Question in Personal Injury in New York

Approximately 11 days ago my mother age 83 fell on her face on government property. She was there on business. The day she fell she was assisted up by a security guard at the facility. In addition, the agency she was visiting did not call for an ambulance. Instead they had one of their private cars come along to transport her to any hospital she chose. She chose not to go directly to a hospital but home instead. Once she reached home someone advised her that she was bleeding from her nose. She then went to the hospital on her own. She was admitted to the hospital the same day, and remained there for 10 days. I am writing to ask if she has a case, even though 11 days has elapsed, and she has been released from the hospital?

In order to answer your question more information is needed

How did she fall? Why? Where? Federal Government property or State or City? Was a report written? Do you have it? What injuries did your mother sustain? What is her current condition? What was the state of her health before she fell?

All of these questions and more are necessary to assess the case. Even if the answers to all of these questions are supportive of a lawsuit being viable, your mother's advanced age and the fact that this was a slip and/or trip and fall will both negatively impact the value of the case, that is the amount of money that she can get back.

Your mother may have a case, depending on the specific facts and circumstances of the fall (what caused her to fall) and the extent of her injuries. There are other important factors to consider: one, since this happened on business, she may be entitled to Workers Compensation and, 2, since this was government property, you need to be aware of the very strict (and shorter) time limitations for filing a claim and suit.
