Legal Question in Personal Injury in New York

A few months back as I was crossing the street at night under a lamp post and on a straight-away, my dog and I were hit by a car. Because my dog pushed me out of the way, he took the brunt of the hit. The driver had no headlights on and hit us way over the line. My dog nearly died. Needless to say there was 2 different police departments at the scene. The one who took the report never questioned me or witnesses, he only questioned the driver. (It was evident that the driver tried to drive away but could not due to damage to her car) The driver told police that my dog ran out of nowhere, which is not true. I need to possibly have surgery. After contacting the drivers insurance company, I learned she never reported the accident. She reported the accident over a month later when I sent her a certified letter stating she would be held personally liable. After she finally reported the accident to her insurance company, they contacted me, received my revised police report and denied any claims stating they were sticking with their customer. Do I have any recourse? Should I contact a lawyer? Between my medical bills and my dogs, I have racked up over $20k out of pocket expenses.
