Legal Question in Personal Injury in New York

I fell down in oct of 2006 and ended up with a fracture/chipped Talus bone in my ankle. Cast for 5 weeks and out of work --still today. It is my understanding that the landlord of the rental property DOES NOT have any insurance. Therefore, I cannot retain anyone to help me any further. I walk with a limp now, will probably always be a disability for me. It just does not seem fair or just at all that a property owner ends up ''better off'' to NOT have any insurance coverage in this situation. YET, she sits back and collects rental income every month; while I have to live with what happened to me due to a VERY poorly maintained step, railing and sidwalk area. How can this be so NOT WORTH be represented?

How do you know the LL doesn't have insurance? Has an attorney taken this matter subject to investigation only to later reject it? Obviously, the landlord has assets - the property. If there is no insurance, there will likely be no settlement, but this doesn't mean you can't win in court.
