Legal Question in Personal Injury in New York

Hello and thank you again -- do you remember we spoke on the phone several months ago? As far as a mediation goes (which I am having set up as we speak) if by some remote chance they were to show I would not be happy with a small sum. I am going to pursue small claims court and ask for the full $5,000. That's just about what his net was. I wonder if a judge would be so bold as to award that to me and saying to him you forfeit it for your conduct. What do you think a SCC judge would do? I think he should forfeit his fee but of course I'll take what is determined and then that will truly be the end to this. Personally I think he got off easy with the Grievance Committee.

Your small claims filing fee is less than fifty dollars. Give it a shot. I believe you have less than a fifty percent chance for recovery, but I would take the chance anyway.
