You have a more important question that you need answered. That is, can you sue anyone else responsible for your injury. Namely, the manufacturer or designer of whatever instrumentality caused you to lose your finger, if that is the case. I need more information. You should have this matter reviewed by a qualified lawyer. Even though worker's comp prohibits suing the employer for injuries in Tort (negligence) and provides a remedy in worker's compensation, frequently serious work related injuries give rise to lawsuits against third parties for negigence or for products liability.
